1. Introduction

Welcome to Tixty ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the Tixty website, services, and applications (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

Tixty is a game server hosting platform registered and operating under the laws of Nepal. Our services are designed to provide game server hosting solutions to customers worldwide.

2. Use of Services

Our Services are designed to provide game server hosting and related services. You agree to use our Services only for lawful purposes and in accordance with these Terms. You are responsible for all activities that occur under your account.

2.1 Account Registration

To access certain features of our Services, you may need to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

2.2 Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Using our Services for any illegal purpose or in violation of any local, state, national, or international law
• Hosting content that violates copyright, trademark, or other intellectual property rights
• Attempting to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running our Services
• Using our Services to distribute malware, viruses, or other malicious code
• Engaging in any activity that disrupts or interferes with our Services

3. Payment and Billing

Tixty operates on a pay-as-you-go model. By using our Services, you agree to the following payment terms:

3.1 Account Credits

Our Services require you to top up your account with credits. These credits are automatically deducted based on your usage of our Services. You are responsible for maintaining sufficient credits in your account to ensure uninterrupted service.

3.2 Payment Methods

We accept various payment methods for account top-ups, including credit/debit cards, PayPal, and bank transfers. All payments are processed securely through our payment partners. By providing your payment information, you represent and warrant that you are authorized to use the designated payment method.

3.3 Taxes

All fees are exclusive of taxes unless stated otherwise. You are responsible for paying all applicable taxes, including Value Added Tax (VAT) at the rate of 13% as per Nepalese tax regulations. For international customers, applicable taxes will be charged according to your local tax laws. All prices are listed in US Dollars (USD).

3.4 Automatic Deductions

You authorize us to automatically deduct credits from your account based on your usage of our Services. Usage is calculated based on the resources consumed, such as server uptime, storage, bandwidth, and additional features activated.

3.5 Refunds

Refunds are governed by our Refund Policy. Please refer to our Refund Policy for information on when and how refunds are processed.

4. Intellectual Property

The Services and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Tixty, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Services.

5. Compliance with Nepalese Law

As a company registered in Nepal, Tixty operates in compliance with all applicable Nepalese laws and regulations, including but not limited to:

• The Electronic Transaction Act, 2063 (2008)
• The Companies Act, 2063 (2006)
• Nepal Rastra Bank regulations regarding digital payments
• Income Tax Act, 2058 (2002) and its amendments

We are registered with the Office of Company Registrar (OCR) of Nepal and comply with all reporting and tax obligations as required by the Inland Revenue Department of Nepal. All financial transactions are conducted in accordance with the foreign exchange regulations set by Nepal Rastra Bank.

6. Limitation of Liability

To the maximum extent permitted by law, Tixty shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your access to or use of or inability to access or use the Services.

7. Termination

We may terminate or suspend your account and bar access to the Services immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the Services, or contact us at support@tixty.gg to request account deletion.

8. Changes to Terms

We may modify these Terms at any time. If we make changes, we will provide notice of such changes, such as by sending an email notification, providing notice through our Services, or updating the "Last Updated" date at the beginning of these Terms. Your continued use of our Services following the posting of updated Terms means that you accept and agree to the changes.
